IH Wallet Terms and Conditions
Effective Date: 1st January 2024
1. Acceptance of Terms
By using the Imani Health website, USSD system and mobile app, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the app.
2. Description of Service
Imani Health is a savings wallet that enables you save for healthcare. The savings will be done via mobile money service M-Pesa or bank transfer. The transaction will happen either through the mobile application or USSD service. The money saved is for healthcare and health related purposes and will be paid directly to a hospital/health service provider.
3. User Eligibility
To use the IH Wallet system and mobile app, you must be 18 years of age and have the legal capacity to enter into a binding contract.
4. User Account
To use certain features of the app, you may need to create a user account. You are responsible for maintaining the confidentiality of your account credentials.
For you to create an account with the application, you must understand and comply with the following:
- You must be of 18 years of age and above
- You must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your account on Our Service.
- You are responsible for safeguarding the password that You use to access the Service.
- You agree not to disclose Your password to any third party.
- You must notify us immediately upon becoming aware of any breach of security or unauthorized use of Your account.
5. Intellectual Property
The app and its content are protected by intellectual property laws. You may not use, reproduce, or distribute any part of the IH Wallet app, logo, images, systems or anything pertaining IH Wallet Ltd without our written permission.
6. User Conduct
You agree to use the app in accordance with all applicable laws and regulations. You may not use the app for any illegal or unauthorized purpose.
7. Disclaimer of Warranties
The app is provided “as is” without warranties of any kind. We do not warrant that the app will be error-free or uninterrupted.
8. Limitation of Liability
The Service is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the IH Wallet Ltd on its own behalf expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice.
Without limiting the foregoing, neither IH Wallet makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service; or (iv) that the Service, its servers, the content, or e-mails sent from or on behalf of IH Wallet are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.
9. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or liabilities arising out of your use of the app.
10. Termination
We may terminate or suspend Your Account immediately, without prior notice or liability, if You breach these Terms and Conditions. Upon termination, your right to use the Service will cease immediately. If you wish to terminate Your Account, you may simply discontinue using the Service.
11. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Kenya
12. Changes to Terms
We may update these Terms and Conditions from time to time. We will notify you of any changes by posting the new terms on the app.
